The act of gathering information or evidence for use in a trial.

The formal and informal exchange of information between sides in a case. Usually, you do not file discovery in the court. It is information for the parties to use as they prepare their cases. In divorce cases, Civil Rule 26.1 requires both parties to give full disclosure of financial information to each other.
